1. PURPOSE
This Refund & Cancellation Policy applies to consultation bookings made through:
irelandimmigrationcheck.com
The service covered by this Policy is the booking of a consultation call provided by Career Ireland Seirbhísí Limited, trading as CareerIreland ("CareerIreland", "we", "us" or "our").
This Policy explains:
- CareerIreland's commercial refund position;
- cancellation of consultation bookings;
- rescheduling;
- missed appointments;
- technical problems;
- duplicate payments;
- CareerIreland-initiated cancellations; and
- applicable statutory consumer rights.
This Policy should be read together with the Consultation Booking & Payment Terms, Terms & Conditions and Privacy Policy.
2. CONSULTATION BOOKINGS ARE NON-REFUNDABLE AS A COMMERCIAL POLICY
CareerIreland's commercial policy is that confirmed consultation booking fees are non-refundable.
The consultation fee is paid to secure and administer a specific consultation appointment.
However, this commercial policy does not exclude, restrict or override any statutory consumer right or remedy that cannot lawfully be excluded.
Where applicable law provides a right to cancel, terminate, obtain a refund, obtain a price reduction or receive another remedy, that right remains unaffected.
3. WHAT THE CONSULTATION FEE COVERS
The consultation fee is payment for the booked consultation service.
It does not constitute payment for:
- a guaranteed immigration outcome;
- a visa approval;
- an employment permit;
- citizenship;
- naturalisation;
- immigration permission;
- entry to Ireland;
- an application approval; or
- any other decision by an Irish Government authority.
4. NO REFUND BASED ON IMMIGRATION OUTCOME
A customer is not entitled to a refund merely because:
- an immigration route is unavailable;
- the customer is later found not to qualify;
- a visa application is refused;
- an employment permit is refused;
- citizenship or naturalisation is refused;
- an immigration permission is refused or not granted;
- the customer decides not to proceed with an application; or
- the customer does not achieve the immigration outcome they hoped for.
The consultation is a paid service and not a guarantee of an immigration result.
This does not affect statutory rights relating to the actual provision of the consultation service.
5. ONLINE CANCELLATION RIGHTS
Where a consultation contract is concluded online and the applicable statutory requirements provide a consumer with a right to cancel, the statutory cancellation period will apply.
Under the Irish Consumer Rights Act 2022, the cancellation period for a distance service contract generally expires 14 days after the contract is concluded, subject to the statutory provisions and exceptions.
CareerIreland will not use this Policy to remove or restrict a cancellation right that applies by law.
6. HOW TO EXERCISE A STATUTORY CANCELLATION RIGHT
Where you have a statutory cancellation right, you may exercise it by clearly informing CareerIreland that you wish to cancel.
You may contact us using the contact details provided in this Policy.
You do not have to use particular legal wording, provided your communication clearly communicates your decision to cancel.
The CCPC states that consumers exercising an applicable online cancellation right should inform the business within the relevant cancellation period.
7. SERVICE STARTING DURING THE CANCELLATION PERIOD
If you request that CareerIreland provide the consultation before the applicable statutory cancellation period expires, the service may begin during that period.
Where the law permits, if you subsequently exercise a statutory cancellation right after the service has begun, you may be required to pay a proportionate amount for the service supplied before cancellation.
Where the consultation has been fully performed during the cancellation period and the statutory conditions for loss of the cancellation right are satisfied, the statutory cancellation right may cease.
The applicable law will determine the customer's rights in each case.
8. EXPRESS REQUEST TO START THE CONSULTATION
Where required, the booking process may provide an opportunity for the customer to expressly request that CareerIreland begin providing the consultation service before the expiry of the statutory cancellation period.
Where such a request is made, the customer should understand that statutory rules concerning payment for services already supplied may apply if the customer subsequently cancels.
9. CUSTOMER-INITIATED CANCELLATION OUTSIDE STATUTORY RIGHTS
If no statutory cancellation or refund right applies, CareerIreland's commercial policy is that the consultation booking fee is non-refundable.
A discretionary refund is not automatically provided because a customer:
- changes their mind;
- becomes unavailable;
- no longer requires the consultation;
- finds another service provider;
- decides not to travel to Ireland;
- decides not to proceed with an immigration route; or
- no longer wishes to discuss the matter.
CareerIreland may consider exceptional circumstances at its discretion, but is not obliged to provide a discretionary refund unless required by law or expressly agreed.
10. RESCHEDULING
Customers who cannot attend their scheduled consultation should contact CareerIreland as early as possible.
Where practicable, CareerIreland may offer an alternative appointment time.
Rescheduling is subject to:
- availability;
- the consultation type;
- timing of the request;
- operational circumstances; and
- any specific booking conditions.
Rescheduling is not guaranteed.
11. RESCHEDULING DOES NOT CREATE A REFUND RIGHT
Where CareerIreland offers a rescheduled appointment, rescheduling does not itself create an additional refund entitlement.
The original consultation booking remains applicable to the rescheduled appointment.
12. MISSED APPOINTMENTS
If a customer does not attend the consultation or cannot be reached at the scheduled time, the appointment may be treated as a missed appointment.
Subject to applicable statutory rights, a missed appointment does not automatically entitle the customer to a refund.
Where reasonably practicable, CareerIreland may offer a rescheduling option.
13. LATE ARRIVAL
If a customer joins or becomes available after the scheduled consultation start time, the consultation may still end at the originally scheduled time.
CareerIreland may, at its discretion, accommodate a late arrival where circumstances permit.
Late arrival does not automatically create a right to:
- extend the consultation;
- reschedule;
- receive a refund; or
- receive a partial refund.
This is subject to any statutory rights that may apply.
14. CUSTOMER UNAVAILABILITY
Customers are responsible for ensuring that they are available at the booked time.
This includes checking:
- the appointment date;
- the appointment time;
- the relevant time zone;
- booking instructions;
- email communications; and
- any required call or meeting details.
15. CAREERIRELAND-INITIATED CANCELLATION
If CareerIreland needs to cancel a confirmed consultation, we will seek to provide reasonable notice where practicable.
Depending on the circumstances, CareerIreland may offer:
- an alternative appointment;
- rescheduling; or
- an appropriate refund or other remedy.
Any statutory consumer rights remain unaffected.
16. CAREERIRELAND UNABLE TO PROVIDE THE SERVICE
If CareerIreland is unable to provide a paid consultation and does not provide an alternative service or rescheduled appointment that the customer accepts, the customer may be entitled to a refund or other remedy in accordance with applicable law.
Irish consumer law requires services to be provided as agreed and provides remedies where services are not supplied or are not provided to the required standard.
17. TECHNICAL FAILURE BEFORE THE CONSULTATION
If a technical problem prevents the consultation from taking place before it begins, CareerIreland may seek to:
- resolve the technical issue;
- provide an alternative communication method;
- reschedule the consultation; or
- provide another appropriate remedy.
The appropriate response will depend on the circumstances and whether the technical issue is attributable to CareerIreland, a third-party provider or the customer.
18. TECHNICAL FAILURE DURING THE CONSULTATION
If a technical issue interrupts an ongoing consultation, CareerIreland may seek to:
- reconnect;
- continue using another communication method;
- reschedule the affected portion;
- provide another reasonable solution; or
- consider an appropriate remedy where the service cannot reasonably be completed.
19. CUSTOMER-SIDE TECHNICAL PROBLEMS
Customers are responsible for having suitable:
- devices;
- Internet access;
- telephone connectivity;
- browsers;
- software;
- microphones;
- cameras; and
- other equipment required for the selected consultation format.
Where a consultation cannot proceed solely because of the customer's equipment, connection or software, a refund is not automatically available.
This does not affect any statutory rights that may apply to the service itself.
20. DUPLICATE PAYMENTS
If you believe you have paid more than once for the same consultation booking, contact CareerIreland promptly.
We will review the relevant transaction information.
Where a genuine duplicate payment is identified, CareerIreland may arrange an appropriate correction or refund.
21. PAYMENT PROCESSING ERROR
If your bank account or payment method appears to have been charged but the booking was not successfully completed, contact CareerIreland with the relevant transaction information.
CareerIreland may need to verify the payment with the relevant payment provider.
22. PAYMENT PROVIDER ISSUES
Payments may be processed through third-party payment providers, including Stripe.
Where a payment issue originates with a third-party payment provider, CareerIreland may need to obtain information from that provider before resolving the issue.
This does not affect statutory rights relating to the underlying consultation contract.
23. CHARGEBACKS
If you believe a payment was made in error or that there is a legitimate dispute concerning the service, you should contact CareerIreland so that the matter can be investigated.
Nothing in this Policy prevents a customer from exercising a lawful right to contact their payment provider or exercise any other statutory remedy.
24. SERVICE QUALITY
The non-refundable commercial policy does not mean that CareerIreland can exclude responsibility for failing to provide a service in accordance with applicable consumer law.
Where a service has not been provided as agreed or there is a qualifying service problem, applicable statutory remedies may include:
- correction or re-performance;
- price reduction;
- termination;
- refund; or
- another remedy provided by law.
The appropriate remedy depends on the circumstances.
25. NO REFUND FOR UNSATISFACTORY IMMIGRATION OUTCOME
The consultation is not a success-fee arrangement.
CareerIreland does not promise that the consultation will result in:
- eligibility;
- visa approval;
- employment;
- residence;
- citizenship;
- naturalisation; or
- any other immigration outcome.
A disappointing immigration outcome does not, by itself, mean that the consultation service was improperly provided.
26. NO REFUND FOR FAILURE TO FOLLOW ADVICE
Where appropriate information or recommendations are provided during a consultation, the customer remains responsible for deciding whether and how to act on that information.
A customer is not entitled to a refund merely because they:
- choose not to follow information provided;
- take a different course of action;
- submit an application differently;
- fail to provide requested information; or
- fail to take recommended steps.
This does not affect statutory rights concerning the actual provision of the consultation service.
27. INFORMATION PROVIDED BY THE CUSTOMER
CareerIreland may rely on information supplied by the customer when preparing for or conducting a consultation.
CareerIreland is not responsible for an outcome caused by information that is:
- inaccurate;
- incomplete;
- misleading;
- outdated; or
- withheld by the customer.
This does not exclude responsibility for the proper provision of the consultation service itself.
28. IMMIGRATION AUTHORITY DECISIONS
CareerIreland does not control decisions made by:
- Immigration Service Delivery;
- the Department of Justice;
- visa authorities;
- employment-permit authorities;
- embassies;
- consulates; or
- other competent authorities.
A refund will not be provided merely because an authority makes a decision that differs from information discussed during a consultation.
29. REFUNDS WHERE REQUIRED BY LAW
Where a refund is required under applicable law, CareerIreland will process the refund in accordance with the applicable legal requirements.
For applicable statutory cancellation rights, Irish consumer guidance states that refunds should generally be made within 14 days of cancellation, subject to the relevant statutory conditions.
30. METHOD OF REFUND
Where a refund is due, CareerIreland will generally return the relevant amount using the original payment method unless:
- another method is agreed; or
- applicable law permits another arrangement.
31. REFUND OF PARTIALLY PROVIDED SERVICES
Where applicable law provides a refund or price reduction for a service that has been partially provided, the amount may depend on:
- the service already supplied;
- the value of the service supplied;
- the nature of the defect or issue;
- the contractual terms; and
- the applicable legal requirements.
32. REFUND REQUEST PROCESS
Where you believe you are entitled to a refund, contact CareerIreland and provide:
- your name;
- booking reference, where available;
- consultation date;
- payment information sufficient to identify the transaction;
- reason for the request; and
- any relevant supporting information.
CareerIreland may request additional information reasonably necessary to assess the request.
33. COMPLAINTS ABOUT REFUNDS
If you disagree with a refund decision, you may raise the matter through CareerIreland's Complaints & Customer Support Policy.
Nothing in the complaints process prevents you from exercising applicable statutory rights.
34. STATUTORY RIGHTS PREVAIL
Nothing in this Policy is intended to:
- exclude statutory consumer rights;
- restrict a statutory cancellation right;
- exclude remedies that cannot lawfully be excluded;
- misrepresent a customer's legal rights; or
- prevent a customer from exercising a legal remedy.
Where a provision of this Policy conflicts with a mandatory statutory right, the applicable statutory right will prevail.
