3. YOUR DATA-PROTECTION RIGHTS
Depending on the circumstances and applicable law, you may have the right to:
- access your personal data;
- request correction of inaccurate or incomplete information;
- request erasure of personal data;
- request restriction of processing;
- object to certain processing;
- request data portability;
- withdraw consent where processing is based on consent; and
- exercise rights relating to qualifying automated decision-making and profiling.
These rights are subject to the conditions and limitations provided by applicable law.
The Data Protection Commission confirms these rights and notes that they are not absolute in every circumstance.
4. HOW TO MAKE A REQUEST
A request may be made in writing or verbally.
For efficient handling, CareerIreland recommends submitting requests in writing and clearly identifying the right being exercised.
You may contact CareerIreland using the contact details provided in this Procedure.
A request does not need to use technical legal terminology.
5. INFORMATION TO INCLUDE
Where possible, provide:
- your name;
- email address or other contact details;
- the right you wish to exercise;
- a description of the information concerned;
- the relevant service or interaction;
- booking reference, where applicable; and
- any other information that may reasonably help CareerIreland locate the relevant records.
You do not need to provide information that is unrelated to your request.
6. IDENTITY VERIFICATION
CareerIreland may request additional information where there are reasonable doubts about the identity of the person making a request.
The purpose of verification is to prevent personal information being disclosed to the wrong person.
Any information requested for verification should be proportionate to the circumstances.
The DPC confirms that controllers may request additional information necessary to confirm identity where they have reasonable doubts about the identity of the requester.
7. RIGHT OF ACCESS
You may request confirmation of whether CareerIreland processes personal information concerning you.
Where applicable, you may also request a copy of your personal data together with relevant information concerning its processing.
This may include information about:
- purposes of processing;
- categories of personal data;
- recipients;
- retention;
- applicable rights;
- sources of information where relevant; and
- automated decision-making or profiling where applicable.
The DPC confirms that the right of access includes both access to personal data and specified information about its processing.
8. ACCESS REQUESTS AND SCOPE
If CareerIreland processes a large amount of information concerning you, we may ask you to clarify the scope of a broad request where reasonably necessary.
A request for clarification will not be used simply to delay responding to a valid request.
Where you do not provide clarification, CareerIreland will still consider the original request and seek to comply with it to the extent required by law.
9. RESPONSE TIME FOR ACCESS REQUESTS
CareerIreland will respond to a valid request without undue delay and, in general, within one month of receiving the request.
Where a request is complex or multiple requests have been received, the applicable period may be extended by up to two additional months where permitted by law.
If an extension is necessary, CareerIreland will inform you within the initial one-month period and explain the reason for the extension.
This reflects the DPC's guidance on handling access and portability requests.
10. RIGHT TO RECTIFICATION
If personal information held by CareerIreland is inaccurate, you may request that it be corrected.
Where information is incomplete, you may request that it be completed, including by providing supplementary information.
CareerIreland will consider and, where appropriate, correct inaccurate or incomplete information without undue delay.
The DPC confirms the right to rectification under Articles 16 and 19 GDPR.
11. RIGHT TO ERASURE
You may request deletion of your personal information where one of the applicable legal grounds for erasure exists.
For example, erasure may apply where:
- the information is no longer necessary for its original purpose;
- consent has been withdrawn and there is no other lawful basis;
- you have successfully objected to processing;
- the information has been unlawfully processed; or
- erasure is required by law.
The right to erasure is not absolute.
The DPC identifies circumstances where information may lawfully need to be retained, including certain legal obligations and the establishment, exercise or defence of legal claims.
12. RIGHT TO RESTRICTION
You may request restriction of processing in circumstances provided by law.
For example, restriction may apply where:
- you contest the accuracy of information;
- processing is unlawful but you request restriction rather than deletion;
- CareerIreland no longer needs the information but you require it for a legal claim; or
- you have objected to processing and the objection is being assessed.
Where processing is restricted, information may generally be stored but not otherwise processed except in circumstances permitted by law.
The DPC identifies these circumstances under Article 18 GDPR.
13. RIGHT TO OBJECT
You may have a right to object to certain processing depending on the legal basis and purpose of the processing.
Where personal information is processed for direct marketing, you have a right to object to such processing.
Where a valid objection applies, CareerIreland will cease the relevant processing unless another lawful exception applies.
14. DIRECT MARKETING OBJECTION
You may object to direct marketing at any time.
Where you object to direct marketing, CareerIreland will stop processing your personal information for that purpose, subject to any limited processing necessary to maintain an appropriate suppression or opt-out record.
You do not need to provide a reason for a direct-marketing objection.
15. RIGHT TO DATA PORTABILITY
Where the legal conditions for data portability apply, you may request your personal data in a structured, commonly used and machine-readable format.
The right to portability generally applies where processing is based on:
- consent; or
- a contract,
and the processing is carried out by automated means.
Where applicable, you may also request that the information be transmitted directly to another controller where technically feasible.
The DPC distinguishes data portability from the broader right of access and confirms the requirement for a commonly used and machine-readable format.
16. WITHDRAWAL OF CONSENT
Where processing is based on your consent, you may withdraw that consent.
Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
Withdrawal of consent also does not necessarily require CareerIreland to delete information where another lawful basis for retaining or processing it applies.
17. COOKIE CONSENT
Cookie and similar tracking preferences may be managed through the Website's Cookie Preference Centre.
Changing cookie preferences is separate from exercising broader GDPR rights.
The Cookie Policy and Cookie Consent Notice & Preference Centre provide further information.
18. AUTOMATED PROCESSING AND PROFILING
Where CareerIreland uses automated processing or profiling, applicable information and rights are addressed in the AI & Automated Eligibility Assessment Disclaimer and Privacy Policy.
Where a qualifying decision is based solely on automated processing and produces legal or similarly significant effects, specific GDPR protections may apply.
The existence and scope of those protections depend on the actual processing and applicable legal requirements.
19. CHALLENGING AN AUTOMATED RESULT
If you believe an automated eligibility assessment is inaccurate, you may contact CareerIreland and explain the issue.
Where appropriate, provide:
- the relevant assessment;
- the information you believe was incorrectly processed;
- the result received; and
- any relevant supporting information.
This procedure does not constitute an appeal against an Irish Government immigration decision.
20. THIRD-PARTY DATA
If your personal information is processed by a third-party provider on CareerIreland's behalf, CareerIreland may need to coordinate with that provider when responding to your request.
Where appropriate, CareerIreland will take reasonable steps to ensure that relevant requests are addressed within the applicable legal framework.
21. RECIPIENTS OF PERSONAL DATA
Where applicable, an access request may include information concerning recipients or categories of recipients to whom personal information has been disclosed.
The extent of information provided will depend on the applicable legal requirements and any relevant restrictions.
22. INFORMATION RELATING TO OTHER PEOPLE
A record may contain personal information belonging to both the requester and another person.
CareerIreland will consider the rights and freedoms of other individuals before disclosing such information.
Where necessary, information relating to another person may be withheld or appropriately redacted.
The DPC confirms that the right of access must be balanced against the rights and freedoms of others.
23. CONFIDENTIAL AND PRIVILEGED INFORMATION
Certain information may be subject to legal restrictions, confidentiality obligations, privilege or other applicable exemptions.
Where CareerIreland relies on a lawful restriction, the response will explain the relevant position to the extent required by law.
24. MANIFESTLY UNFOUNDED OR EXCESSIVE REQUESTS
Most data-subject requests are handled free of charge.
In limited circumstances, where a request is manifestly unfounded or excessive, particularly because of its repetitive nature, applicable law may permit CareerIreland to:
- charge a reasonable fee; or
- refuse to act on the request.
The threshold for relying on this provision is high and CareerIreland will consider the circumstances carefully.
The DPC confirms that such requests should only be refused or charged for in limited circumstances and that the controller bears responsibility for justifying the decision.
25. NO RESPONSE DOES NOT APPLY
CareerIreland will not simply ignore a valid rights request.
If CareerIreland cannot take the requested action, it will explain the relevant reason and, where required, inform you of your right to complain to the supervisory authority or seek a judicial remedy.
The DPC confirms that even where a request is refused or partly refused, the organisation must respond and explain the applicable restriction or reason.
26. REQUEST OUTCOME
After reviewing a request, CareerIreland may:
- provide the requested information;
- correct information;
- delete information;
- restrict processing;
- provide portable information;
- stop relevant marketing;
- explain why a requested action cannot be taken; or
- take another action required by applicable law.
27. REQUEST RECORDS
CareerIreland may maintain a record of:
- the request;
- the date received;
- identity-verification steps;
- actions taken;
- correspondence;
- response date; and
- any applicable restriction or exemption.
Such records may be retained to demonstrate compliance with data-protection obligations.
28. DATA RETENTION AFTER A REQUEST
Exercising a data-protection right does not automatically require all information relating to the requester to be deleted.
Certain records may need to be retained for:
- legal obligations;
- demonstrating compliance;
- complaints;
- disputes;
- legal claims;
- accounting; or
- other lawful purposes.
The Data Retention & Deletion Policy explains the broader retention framework.
29. COMPLAINT TO THE DATA PROTECTION COMMISSION
If you believe your data-protection rights have not been properly addressed, you may raise your concern with the Data Protection Commission (DPC), Ireland's supervisory authority.
The DPC recommends giving the organisation an opportunity to address the issue first where appropriate, although this does not remove your right to contact the DPC.
30. JUDICIAL REMEDY
Nothing in this Procedure prevents you from exercising any judicial remedy available under applicable data-protection law.
31. NO FEE FOR ORDINARY REQUESTS
CareerIreland will generally process valid data-subject rights requests without charging a fee.
Any exception will be considered only where permitted by applicable law.
32. SECURITY OF REQUESTS
CareerIreland will take reasonable steps to ensure that personal information is not disclosed to an unauthorised person when responding to a rights request.
This may include:
- identity verification;
- secure electronic communication;
- controlled access to records; and
- appropriate redaction.
33. REQUESTS MADE BY REPRESENTATIVES
Where a person makes a request on behalf of another individual, CareerIreland may require evidence that the representative is authorised to act for that individual.
This may be particularly important where the request concerns access to personal information.
34. CHILDREN AND VULNERABLE INDIVIDUALS
Where a request concerns a child or another person who is represented by a parent, guardian or authorised representative, CareerIreland may take appropriate steps to establish authority and protect the individual's rights.
