1. PURPOSE
This document provides the approved wording and functional requirements for the Cookie Consent Notice and Cookie Preference Centre used on:
irelandimmigrationcheck.com
It is intended to work together with the Cookie Policy and Privacy Policy.
The consent mechanism should be configured to reflect the cookies and similar tracking technologies actually deployed on the Website.
2. FIRST-LAYER COOKIE BANNER
The initial cookie banner should provide clear information before any non-exempt cookies or tracking technologies are activated.
Recommended wording
We use cookies and similar technologies
We use necessary cookies to operate and secure our Website. With your permission, we may also use optional cookies and similar technologies for analytics, advertising, conversion measurement and other Website improvements.
You can accept or reject optional technologies, or manage your preferences by category.
Please see our Cookie Policy for more information.
Buttons
Accept All
Reject Optional
Manage Preferences
The buttons should be presented in a clear and balanced manner.
3. BANNER REQUIREMENTS
The banner should:
- appear before non-exempt tracking technologies are activated;
- clearly explain the purposes for which optional technologies are used;
- provide a genuine choice;
- allow optional technologies to be rejected;
- provide access to the Cookie Policy;
- provide access to the Preference Centre;
- avoid pre-selected optional consent;
- avoid misleading design;
- avoid making rejection substantially more difficult than acceptance; and
- remain distinguishable from ordinary Website content.
The DPC states that users must be able to make a genuine and granular choice and that consent cannot be validly obtained through pre-checked boxes or similar default-on mechanisms.
4. NO IMPLIED CONSENT
CareerIreland should not use wording such as:
"By continuing to browse this website, you agree to cookies."
Continued browsing should not be treated as consent to optional cookies or tracking technologies where consent is required.
5. SECOND-LAYER PREFERENCE CENTRE
When the user selects Manage Preferences, the Preference Centre should display the available categories and allow the user to make a choice.
Suggested opening text
Cookie Preferences
We use cookies and similar technologies for different purposes. Some are necessary for the Website to operate, while others help us understand Website usage or measure advertising.
You can choose which optional categories you allow.
You can change your choices at any time.
6. NECESSARY COOKIES
Category
Strictly Necessary
Status
Always Active
Description
These cookies and similar technologies are required for Website functions that you have requested or that are otherwise exempt from the applicable consent requirement.
They may support:
- Website operation;
- security;
- sessions;
- forms;
- eligibility-assessment functionality;
- consultation booking;
- payment functionality;
- consent management; and
- other essential functions.
Control
This category should not be presented as an optional consent toggle where the technologies genuinely satisfy the applicable exemption.
7. PREFERENCE COOKIES
Category
Preferences
Description
These technologies may remember choices or settings made by you, such as Website preferences or interface settings.
Default
Off until consent, where consent is required.
Control
Allow Preferences
8. ANALYTICS COOKIES
Category
Analytics
Description
These technologies help CareerIreland understand how visitors use the Website and how the Website performs.
They may help us understand:
- page visits;
- navigation;
- Website interactions;
- performance;
- technical issues;
- general usage patterns; and
- the effectiveness of Website improvements.
Default
Off until consent.
Control
Allow Analytics
Analytics cookies generally require consent under the DPC's current guidance.
9. ADVERTISING & MARKETING
Category
Advertising & Marketing
Description
These technologies may be used to measure advertising performance, understand advertising interactions and support relevant marketing activities.
They may include technologies provided by advertising or social-media platforms.
Default
Off until consent.
Control
Allow Advertising & Marketing
10. CONVERSION TRACKING
Where conversion tracking is separately categorised in the consent-management platform:
Category
Conversion Tracking
Description
These technologies help measure whether users take specified actions after interacting with advertising.
Examples may include:
- completing an eligibility assessment;
- submitting an enquiry;
- booking a consultation; or
- completing a payment.
Default
Off until consent.
Control
Allow Conversion Tracking
Conversion tracking is not treated as strictly necessary merely because it is useful for measuring CareerIreland's advertising activity.
If conversion tracking is technically grouped with Advertising & Marketing, it may be presented within that category instead of creating a separate category.
11. META PIXEL
Where Meta Pixel or related Meta technologies are deployed:
Provider
Meta
Purpose
Depending on the configuration, these technologies may support:
- advertising measurement;
- conversion tracking;
- campaign optimisation;
- audience measurement; and
- advertising performance analysis.
Consent
Off until the required consent is obtained.
Meta-related tracking should not be loaded before the relevant consent where consent is required.
12. SOCIAL MEDIA TECHNOLOGIES
Where social-media technologies are deployed:
Category
Social Media
Description
These technologies may support:
- social-media functionality;
- embedded content;
- advertising;
- audience measurement; or
- conversion measurement.
Consent
Off until consent where required.
If social-media technologies are technically part of the Advertising & Marketing category, the Preference Centre may present them within that category.
13. THIRD-PARTY TECHNOLOGIES
The Preference Centre may identify third-party providers whose technologies are actually deployed.
Potential categories include:
- analytics providers;
- advertising platforms;
- social-media platforms;
- payment providers;
- scheduling providers;
- CRM providers;
- security providers; and
- other Website service providers.
Only providers actually deployed on the Website should be listed.
14. COOKIE INVENTORY
The live Preference Centre should, where technically supported, provide access to the current cookie inventory.
For each applicable cookie or technology, the inventory should identify:
- name;
- provider;
- category;
- purpose;
- duration;
- first-party or third-party status; and
- relevant description.
The DPC states that users should receive information about the types of tracking/storage technologies used, their functions and their duration.
15. SAVE PREFERENCES
The Preference Centre should provide a clear control such as:
Save Preferences
When selected, the system should record the user's selected preferences and apply them to optional technologies.
16. REJECT OPTIONAL
The Preference Centre should provide a clear option to reject all optional categories.
Button
Reject Optional
This should result in optional analytics, advertising, conversion and other non-essential tracking technologies remaining disabled, subject to the actual classification and technical configuration.
17. ACCEPT ALL
The Preference Centre may provide:
Accept All
If selected, this should enable all optional categories presented to the user, subject to the actual technologies and purposes disclosed.
18. WITHDRAWAL OF CONSENT
Users must be able to change or withdraw their consent after making an initial choice.
CareerIreland should provide a persistent and reasonably accessible mechanism, such as:
Cookie Settings
or
Manage Cookie Preferences
This may be available through the Website footer or another consistently accessible location.
The DPC requires withdrawal or variation of consent to be as easy as giving consent.
19. WITHDRAWAL FUNCTION
When a user changes a previously accepted category to "off":
- the relevant preference should be recorded;
- applicable optional technologies should cease being activated where technically possible;
- future activation of the relevant technologies should be prevented until consent is given again; and
- the user should receive confirmation that the preference has been updated.
Where a technology cannot technically be removed immediately, the consent-management implementation should ensure that it is not subsequently reactivated without the required consent.
20. CONSENT RECORD
The consent-management system should retain an appropriate record of the user's consent choices.
Where technically and legally appropriate, the record may include:
- date and time;
- consent status;
- selected categories;
- consent-management version;
- relevant Website/domain; and
- technical information necessary to demonstrate the consent state.
The consent record should not itself be used for unrelated purposes.
21. CONSENT EXPIRY / RECONFIRMATION
The consent-management implementation should have an appropriate mechanism for reviewing or reconfirming consent where necessary.
CareerIreland should configure the consent-management system in accordance with current regulatory guidance and the specific technical solution being used.
Where the consent-management system stores a consent state in a cookie or similar technology, the retention period should be proportionate and reviewed periodically.
22. NO PRE-TICKED OPTIONAL CATEGORIES
Optional categories must not be pre-selected.
Examples of unacceptable default settings include:
- Analytics: ON
- Advertising: ON
- Marketing: ON
- Meta Pixel: ON
before the user has actively consented.
The DPC specifically identifies pre-checked or default-on controls as a common compliance problem.
23. NO DECEPTIVE DESIGN
The consent interface should not be designed to pressure users into accepting optional tracking.
For example:
- "Accept All" should not be made disproportionately prominent solely to discourage rejection;
- rejection should not require unnecessary navigation;
- optional categories should not be hidden in a misleading manner;
- the user should not be required to accept optional tracking to access unrelated Website functionality; and
- consent should not be bundled with acceptance of unrelated Terms & Conditions.
The DPC advises against deceptive design or "nudging" users toward a particular cookie choice.
24. NO BUNDLING
Consent for cookies should not be bundled with:
- acceptance of Terms & Conditions;
- consultation booking;
- payment;
- eligibility assessment;
- marketing consent; or
- another unrelated service.
A user should be able to use a requested Website service without consenting to optional tracking where the optional tracking is not necessary for that service.
25. ACCESS TO COOKIE POLICY
The Cookie Policy should remain accessible:
- from the initial banner;
- from the Preference Centre; and
- through the Website footer or another persistent Website location.
Users should be able to read the Cookie Policy without first consenting to optional cookies.
The DPC has highlighted the importance of ensuring that cookie and privacy information remains available to users.
26. ACCESS TO PRIVACY POLICY
The Preference Centre should provide an appropriate link to the Privacy Policy where cookie-related processing involves personal data.
The Privacy Policy explains broader personal-data processing, while the Cookie Policy explains cookies and similar technologies.
27. PAYMENT AND BOOKING
A user should not be required to accept optional analytics or advertising cookies merely to:
- book a consultation;
- make a payment;
- complete an eligibility assessment; or
- use another requested service.
Necessary technologies required for the requested service may remain active where they satisfy the applicable legal exemption.
28. TECHNICAL IMPLEMENTATION
The Website should be configured so that optional tracking technologies are technically prevented from loading before the relevant consent is recorded.
This should include, where applicable:
- analytics tags;
- Meta Pixel;
- advertising scripts;
- conversion tags;
- social-media tracking;
- marketing tags; and
- other non-essential tracking technologies.
The consent-management system should communicate the user's preferences to the relevant tags and scripts.
29. TAG MANAGEMENT
If CareerIreland uses a tag-management system, optional tags should be configured to fire only when the corresponding consent category has been granted.
For example:
Analytics consent = ON
→ Analytics tags may fire.
Analytics consent = OFF
→ Analytics tags must not fire.
Advertising consent = ON
→ Relevant advertising/Meta tags may fire.
Advertising consent = OFF
→ Relevant advertising/Meta tags must not fire.
The actual configuration must reflect the technologies deployed on the Website.
30. COOKIE POLICY CONSISTENCY
The Preference Centre, Cookie Policy and actual Website deployment should remain consistent.
CareerIreland should not:
- list cookies that are not deployed;
- omit material tracking technologies that are deployed;
- describe a technology as necessary when it is actually optional;
- state that a technology is disabled when it is active; or
- state that consent is obtained where the technical implementation does not enforce the consent choice.
The DPC has specifically warned that cookie information should accurately describe the operator's own deployment and use of cookies.
31. PERIODIC REVIEW
CareerIreland should periodically review:
- Website cookies;
- scripts;
- tags;
- pixels;
- local storage;
- advertising technologies;
- analytics technologies;
- third-party integrations;
- consent records; and
- Preference Centre categories.
A review should also be carried out after significant Website or technology changes.
32. CHANGE MANAGEMENT
A new analytics, advertising, social-media or other tracking technology should not be added to the Website without considering:
- its purpose;
- whether it stores or accesses information on a user's device;
- whether consent is required;
- the appropriate consent category;
- the information provided to users;
- the relevant Privacy Policy disclosures; and
- the technical blocking/consent configuration.
33. SUPPORT FOR CONSENT REQUESTS
If a user cannot access or change their cookie preferences through the Website, they may contact CareerIreland.
CareerIreland may provide reasonable assistance in relation to the consent-management mechanism.
